Babin Introduces ORTHO Act to Set Patient Safety Standards for Orthodontic Teledentistry

WASHINGTON, D.C.—U.S. Rep. Brian Babin, R-Texas, a dentist and chairman of the House Science, Space, and Technology Committee, has introduced the Oversight of Responsible Teledentistry for Healthy Outcomes (ORTHO) Act, H.R. 9829, which would set patient safety standards for orthodontic treatment provided through teledentistry.

The bill would require an in-person dental examination before most dental treatment could be delivered via teledentistry, along with an in-person confirmation and X-ray review before orthodontic treatment begins.

It allows exceptions for emergencies, public health programs, and initial orthodontic screenings. The measure authorizes the Federal Trade Commission and state attorneys general to enforce the standards against violators.

“Patients deserve the confidence of knowing their treatment decisions are based on an in-person evaluation, appropriate diagnostic records, and sound clinical judgment, not solely on an online interaction,” said Babin, a practicing dentist for more than 40 years.

The AAO supports the legislation. AAO President Dr. Mike Durbin said the bill provides a framework for the responsible use of teledentistry while protecting patients.
